Harrison Allen is an agent for the introduction of tutor(s) to the Client. Harrison Allen does not provide the tutoring services and the provision of those services is governed by a separate agreement between the tutor and the Client (see these T&Cs here).

The Client agrees to the following terms and conditions in respect of Harrison Allen’s introduction to you of a tutor (the Tutor):

  1. Agreement with the Tutor for the provision of Tutoring services

    By booking a session with the Tutor, the Client agrees to be bound by the terms and conditions attached with the Tutor for the provision of tutoring services. That agreement governs the relationship between the Client and the Tutor and the Client is not permitted to make any private or other arrangements with the Tutor who has been introduced by Harrison Allen.

    A breach of this term will render the Client liable to Harrison Allen for any sums paid direct to the Tutor without deduction and Harrison Allen shall be entitled to seek an injunction against the Client to prevent further breaches. This obligation continues beyond the termination or conclusion of this agreement.

  2. Fee procedures

    As agent for the Tutor, Harrison Allen will agree with the Client a fee based on an hourly rate and collect the fee from the Client by rendering a Statement of Account to the Client at the end of each calendar month for that month’s tuition. Payment by the Client must be made within 10 days of the date of the Statement of Account. Harrison Allen’s preference is for payment to be made by Direct Debit and an additional charge may be made for payments made in any other way.

    As the fee agreed in advance between Harrison Allen (on behalf of the Tutor) and the Client is based upon the hours recorded in the timesheets submitted to Harrison Allen by the Tutor, the timesheets will be posted on-line and the Client is responsible for ensuring that each timesheet is accurate and if there are any discrepancies, the Client should notify Harrison Allen immediately.

    Any expenses must be agreed with the Tutor in advance and notified to Harrison Allen for inclusion in the Statement of Account. Travel costs, if applicable, shall be agreed in advance between the Client and Harrison Allen (on behalf of the Tutor) and will also be added to the Statement of Account.

    The Client agrees not make any payments directly to the Tutor at any time.

  3. Cancellation

    At least 24 hours’ notice must be given by the Client to the Tutor of the cancellation of a tutoring session for any reason whatsoever (unless the cause is deemed by the Tutor to be unavoidable). If less than 24 hours’ notice is given of a cancellation, the Client remains responsible for the full fee and arrangement fee (plus VAT as appropriate) for the missed session and the fee procedures above will apply.

  4. Harrison Allen Policies

    The Client hereby confirms that the Client has read, understood and agrees to comply where relevant with all Harrison Allen Policies (which are available on line on the Harrison Allen website) including but not limited to the Harrison Allen Data Protection Policy.

  5. Liability

    Harrison Allen does not accept any liability for any claims by the Client arising out of or related to the provision of tutoring services by the Tutor.

  6. General

    This agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the Courts of England and Wales.

    These terms constitute the whole agreement between the parties and no variation or alteration of these terms shall be valid unless approved in writing by a Director of Harrison Allen. Harrison Allen reserves the right to alter these terms and conditions and will notify the Client in writing of any changes.

    The Client acknowledges that these terms govern the legal rights and obligations between the Client and Harrison Allen.

Terms and conditions between the
Tutor and the Client

  1. Provision of tutoring services by the Tutor to the Client

    The Tutor agrees to:

    1. Carry out the tutoring services in a professional manner with due skill, diligence and care and observe the Client’s confidentiality at all times in respect to private information; and
    2. Carry out the tutoring services with proper preparation of lessons and a particular course of study; and
    3. Carry out the tutoring services in accordance with the Client’s instructions and/or relevant exam syllabus; and
    4. Carry out the tutoring services and keep Harrison Allen informed of progress with written reports to Harrison Allen as and when requested by Harrison Allen. Harrison Allen shall not have any supervision, direction or control obligations over the Tutor whose methods of working and content of lessons shall be those of the Tutor alone; and
    5. Carry out tutoring services without accepting any additional responsibilities or obligations which lead or might lead to a potential conflict of interest between the Tutor’s provision of tutoring services to the Client and any other interest;
    6. Be responsible for agreeing with the Client what the suitable environment is for the tutoring services to take place. If the Client wishes the Tutor to travel to the Client’s premises then Harrison Allen will agree on behalf of the Tutor an appropriate travel cost charge in advance.
    7. The Tutor is responsible for providing all reasonable teaching materials although if the Tutor and the Client wish to use Harrison Allen’s teaching room, then this can be made available to the Tutor together with the facilities.
    8. Agree in advance with the Client any expenses (save for travel costs which are agreed between Harrison Allen on behalf of the Tutor with the Client, see above)
  2. Holidays, illness and cancellation

    The Tutor will provide to the Client notice of any proposed holiday dates and request the same from the Client. In the event of illness, an alternative date for a tutoring session should be arranged between the Tutor and the Client. The Client must notify the Tutor of a cancellation of a tutoring session at least 24 hours before the session is due. If less than 24 hours’ notice is given by the Client, the Client remains responsible for paying the full fees to Harrison Allen as agent for the Tutor.

  3. Payment procedures and prohibition of other arrangements

    Harrison Allen, as agent for the Tutor, will agree the fee structure based on an hourly rate with the Client. The Tutor and the Client agree that all payments shall be facilitated through and by Harrison Allen as the Tutor’s agent. Harrison Allen will provide a Statement of Account at the end of each month for that month’s tuition by the Tutor which will be payable by the Client within 10 days. The Tutor will not agree any alternative fees with the Client and agrees not to accept any direct payments from the Client and not to render invoices to the Client.

    The Tutor is not permitted to enter into any private arrangements with the Client introduced by Harrison Allen nor with any prospective new client introduced by the Client of Harrison Allen.

    A breach of these terms will render the Tutor liable to account to Harrison Allen for any sums received by the Tutor direct from the Client or from a new client without deduction and Harrison Allen shall be entitled to seek injunctions against both the Client and the Tutor to prevent further breaches. These obligations continue beyond the termination or conclusion of this agreement.

  4. Information to be provided

    If books or materials are agreed by the Client to be purchased by the Tutor then the Tutor shall keep receipts and obtain reimbursement if the items can be returned if not required. The Tutor will provide on-line progress reports to Harrison Allen together with detailed timesheets and information on expenses agreed in advance and incurred for the Client to check.

  5. Liability

    Harrison Allen is not responsible for insurance arrangements in respect of the Tutor providing tutoring services and the Client should note that this is the case.

  6. Confidentiality and Harrison Allen Policies

    Both the Client and the Tutor agree that they will not disclose any confidential information concerning the Tutor, the Client or Harrison Allen to any person for the duration of this agreement and for a period of five years after termination of the agreement, save as required by law, court order or any governmental or regulatory authority.

    The Client and the Tutor hereby confirm that both have read, understood and agree to comply where relevant with all Harrison Allen Policies (which are available on line on the Harrison Allen website).

  7. General
